1. Introduction and acceptance of these terms
Welcome to Even The Dog Has ADHD. These Terms of Use (the “Terms”) govern your access to and use of the website at eventhedoghasadhd.com and any of its pages, content and features (together, the “Website”). The Website is operated by Diana V. Hayes, trading as Even The Dog Has ADHD (“we”, “us” or “our”). By accessing or using the Website, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree with any part of them, please do not use the Website.
Please read these Terms carefully. They include important information about your rights and responsibilities, limitations on our liability, and an essential disclaimer about the nature of our coaching and content (see section 6).
2. Who we are
Even The Dog Has ADHD is a neurodivergence coaching, podcast and media project run by Diana V. Hayes as an individual practitioner. Through the Website we offer 1:1 and group coaching, a podcast and episode directory (“The Bark”), a curated directory of professional services (“The Pack”), a newsletter, and the ability to book a free discovery call. 3. Permitted use of the Website
You may use the Website for your own personal, non-commercial purposes and in line with these Terms. You agree to use the Website lawfully and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of it.
Prohibited uses
When using the Website, you must not: use it in any way that breaches any applicable law or regulation, or that is unlawful or fraudulent; use it to harm, harass, threaten, defame or distress any person, or to send unsolicited advertising; attempt to gain unauthorised access to the Website or any connected server or database; introduce any virus or other malicious material; attack the Website via a denial-of-service attack; use any robot, spider or scraper to access or harvest content without our prior written permission; or reproduce, duplicate, resell or otherwise exploit any part of the Website for commercial purposes without our express written consent. We reserve the right to suspend or restrict your access if we reasonably believe you have breached these Terms.
4. Intellectual property
Unless otherwise stated, all content on the Website — including text, articles, podcast episodes and audio, images, graphics, logos, branding, layouts and design — is owned by or licensed to Diana V. Hayes / Even The Dog Has ADHD and is protected by copyright, trade mark and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and view the content for your own personal and non-commercial use only. Except as permitted above or by law, you must not copy, republish, download, broadcast or distribute our content; scrape or systematically collect it; modify or create derivative works from it; remove any proprietary notices; or use our name, logo or “Even The Dog Has ADHD” identity without our prior written permission. All rights not expressly granted are reserved.
5. Your contributions, comments and submissions
Where the Website allows you to post comments or otherwise submit content (“User Content”), you are responsible for it and agree that it will be accurate, lawful, and not defamatory, offensive, misleading or infringing of anyone else’s rights. You retain ownership of your User Content, but by submitting it you grant us a worldwide, royalty-free, non-exclusive licence to use, store, reproduce, moderate, publish and display it in connection with operating and promoting the Website. We are not obliged to publish or keep any User Content, and may edit, refuse or remove it at our discretion.
6. Coaching content is informational, not medical advice
This section is important, so please read it carefully.
Even The Dog Has ADHD provides coaching, podcast episodes, written material and other content relating to ADHD and neurodivergence. All of this is offered for general informational, educational and supportive purposes only. It is not, and must not be relied upon as, professional advice for your individual situation.
Our coaching and content are not medical, psychological, psychiatric, therapeutic or clinical advice, and do not constitute diagnosis, assessment or treatment of any condition. Coaching is not a substitute for the care of a qualified and appropriately regulated professional, such as a GP, doctor, psychiatrist, psychologist or therapist. You should not use anything on this Website, or anything shared in a coaching session, to diagnose or treat a health problem, to start or stop any medication, or to delay or disregard professional advice. Always seek the guidance of a suitably qualified professional with any questions about your health, mental health or wellbeing.
If you are in crisis, or you believe you or someone else may be in danger or experiencing a medical or mental-health emergency, please contact your local emergency services immediately (in the UK, call 999), or contact your GP, NHS 111, or a crisis support service such as the Samaritans on 116 123.
Any decisions you make based on the content of this Website or our coaching are your own responsibility. Coaching outcomes vary from person to person, and we do not promise or guarantee any particular result.
7. Bookings, discovery calls and paid coaching
You may be able to book a free discovery call or other sessions through the Website using a third-party scheduling tool (currently Calendly). Bookings made through that tool are subject to its own availability, processes and terms. A discovery call is an introductory conversation and does not by itself create any ongoing coaching relationship. Any paid coaching — whether 1:1 or group (including Map-Making, The Well and Wonderland) — is governed by a separate coaching agreement entered into between you and Diana V. Hayes. That separate agreement, not these Terms, sets out the scope, fees, scheduling and cancellation arrangements for paid coaching, and takes priority where there is any conflict.
8. Third-party links and embedded content
The Website contains links to, and embedded content from, third-party websites and services — for example the scheduling tool, our email newsletter service, podcast players, video embeds, social media platforms, and the professional services listed in The Pack. These are provided for your convenience and information only. We do not control, endorse or take responsibility for the content, products, services, availability or practices of any third party, including any listed in The Pack. Inclusion of a link or listing is not a recommendation, and any dealings you have with a third party are solely between you and that third party.
9. No warranties — the Website is provided “as is”
We make the Website and its content available on an “as is” and “as available” basis. While we take reasonable care to keep it accurate and up to date, we make no representations, warranties or guarantees that the Website or its content will be accurate, complete, current or error-free; that it will be available without interruption, secure, or free from viruses; or that any content will meet your particular requirements. To the fullest extent permitted by law, we exclude all implied warranties, conditions and terms. We may suspend, withdraw or restrict the availability of all or any part of the Website for business or operational reasons.
10. Limitation of our liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Subject to that, and to the fullest extent permitted by law: we provide the Website for your personal, non-commercial use and do not accept liability for any business losses; we will not be liable for any loss or damage that is not reasonably foreseeable, or that arises from your use of, or inability to use, the Website or your reliance on its content; and we will not be liable for any loss caused by a virus or other technologically harmful material that may infect your device. As set out in section 6, we are not liable for any decisions you make in reliance on the informational content provided through the Website.
11. Indemnity
You agree to be responsible for, and to reasonably compensate us for, any losses, costs or claims we suffer that arise directly from your misuse of the Website, your breach of these Terms, or your infringement of the rights of any other person, to the extent permitted by law.
12. Privacy and cookies
Our collection and use of personal information through the Website is explained in our Privacy Policy, and our use of cookies in our Cookie Policy. These are handled in line with UK data protection law, including the UK GDPR and the Data Protection Act 2018, and (for cookies) PECR. Please read those policies alongside these Terms.
13. Changes to these Terms and to the Website
We may update or amend these Terms from time to time. Any changes take effect once the updated Terms are posted on this page, and the “Last updated” date will tell you when they were last revised. Your continued use of the Website after changes are posted means you accept the revised Terms. We may also change, update or remove parts of the Website at any time.
14. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or your use of the Website (including non-contractual disputes), are governed by and construed in accordance with the law of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction, although if you live in another part of the United Kingdom you may also be able to bring proceedings in your own jurisdiction.
